Response KLM on ACM
Schiphol provides infrastructure to airlines, including KLM. KLM purchases and uses Schiphol's infrastructure with no choice in the matter. In this sense, it is a "bound user."
The ACM has not established any violation of competition law. However, the supervisor does see possible risks.
KLM considers it important that the conclusions clarify how the relationship with its main partner can be continued. That clarification is laid down in specific commitments.
For the purposes of the mainport, KLM will continue its important relationship with Schiphol in compliance with these commitments.
KLM heeft kennis genomen van de uitkomsten van het door de Autoriteit Consument en Markt (ACM) uitgevoerde onderzoek. ACM onderzocht de contacten vanaf 2010 in het kader van de wederzijds afhankelijke relatie tussen KLM en Schiphol en de gevolgen die deze relatie heeft voor de mededinging.
Schiphol stelt infrastructuur ter beschikking aan luchtvaartmaatschappijen, waaronder KLM. KLM neemt, zonder daartoe keuze te hebben, infrastructuur af van Schiphol. Zij is een zogenaamde gebonden gebruiker.
ACM heeft geen overtreding van de mededingingswet vastgesteld. Wel ziet de toezichthouder mogelijke risico's.
KLM vindt het belangrijk dat de conclusies helder maken op welke wijze de relatie met haar belangrijkste partner kan worden gecontinueerd. Die duidelijkheid is vastgelegd in specifieke toezeggingen.
KLM zal de voor de mainport zo belangrijke relatie tussen haar en Schiphol voortzetten met inachtneming van deze toezeggingen.
