European Court of Justice: Inclusion of international aviation in the EU ETS is legal

Court of Justice of the European Union Advocate General Kokott published (06-Oct-2011) her formal opinion that the inclusion of international aviation in the EU Emissions Trading Scheme (EU ETS) is compatible with international law. Her opinion was that EU legislation does not infringe the sovereignty of other States or the freedom of the high seas guaranteed under international law, and is compatible with the relevant international agreements.
